Background
Inspect 360 Ltd agrees to provide you, the client, with a written report (“Report”) based on a visual, non-invasive inspection of the residential building(s) in accordance with these terms and conditions.
The inspection and Report will be conducted in compliance with the New Zealand Property Inspection Standards NZS 4306:2005 (“Standard”). A copy of the Standard is available from Standards New Zealand.
Scope of the Report
The Report aims to identify significant defects in the Property through a visual, non-invasive inspection of components that are readily available, safe, and easily accessible at the time of inspection. The condition of the internal framing is not assessed.
The inspection will address aspects such as structural stability, weathertightness risks, workmanship quality, and necessary maintenance.
All advice relied upon regarding the Property is contained within the Report. No responsibility is accepted for verbal statements made by inspectors before the Report is delivered.
The Report is intended as a general guide to assist you in evaluating the overall condition of the Property. It is not an assessment of the Property’s value or an endorsement of the purchase decision.
Access
You are responsible for ensuring that the Property is accessible, including areas like the roof cavity and foundation spaces. These areas must be cleared to allow the inspection to proceed.
If reasonable access is not provided, the Report will note the areas that could not be inspected. Additional fees will apply if a re-inspection is required.
Limitations of the Inspection and Report
The Report is valid for 30 days from the inspection date. The Company is not liable for any damage or deterioration occurring after the inspection, including damage caused by severe weather. The weather conditions at the time of the inspection will be noted in the Report, and assessments of defects will consider these conditions.
Observations, comments, and conclusions in the Report are based on visual evidence only. No destructive or invasive testing will be conducted unless explicitly stated in the Report.
The Report is not a structural survey and does not include specialized inspections for plumbing, heating, gas, or electrical systems. It may offer general comments on the age, materials, and apparent condition of such systems. The Report does not cover building component systems, appliances, pest infestation, contamination, grounds, or soil conditions.
The inspection does not include evaluations of items concealed behind walls or joinery, such as plumbing, drainage, wiring, heating, framing, ventilation, insulation, or structural elements, nor does it include items that require moving, such as floor coverings, furniture, appliances, personal property, vegetation, vehicles, debris, or soil.
You must disclose if the Property has been an “As Is, Where Is” property at any point. An extra fee will be charged if the Company reviews related documentation.
If the Property has sustained significant earthquake damage or repairs, you must disclose this information. The Company may not be able to provide accurate conclusions if relevant documentation or information is not provided at the time of inspection.
The following systems will not be inspected or tested, as they have varied functions and techniques that the Company cannot evaluate: heating units, fixed heating sources, underfloor heating, wall fan and panel heaters, night store heaters, towel rails, air ventilation systems, all gas systems, ovens, stoves, cooktops, range hoods, heated mirrors, waste disposal units, electrical circuits, watering systems, security alarms, built-in speaker systems, drop-down projector screens, outdoor lighting, spa and swimming pool systems, septic and water tank systems, irrigation systems, solar heating and power systems, built-in vacuum systems, fire and smoke alarms.
Limitations on Weathertightness Reporting
The Company will assess weathertightness regardless of the Property’s age, but it will not be measured against Appendix A of the Standards or to E2/AS1 of the Building Code, as these require a specialized report.
A non-intrusive moisture reading will be conducted using calibrated equipment, such as a Protimeter SurveyMaster or Trotech T660. The inspection aims to identify areas of abnormal moisture, though readings are not conclusive.
Non-invasive moisture testing does not guarantee weathertightness and depends on prior weather conditions. Water ingress may be intermittent and undetectable by this method.
The Report is not a leaky home/weathertightness report and does not guarantee against future issues.
Pricing and Payment
The price for the Report will be as agreed in writing or at the time of acceptance of these terms.
Standard pricing is based on a m2 range, subject to additional fees:
$195.00 including GST per hour for re-inspections and amendments to the initial Report.
Additional services, such as reviewing EQC documents or conducting specific tests, will require a written fee proposal and agreement before the inspection.
Payment in full is required in advance unless otherwise agreed.
Cancellation
Inspections can be cancelled without charge up to 48 hours before the scheduled time. Cancellations within 24-48 hours before the inspection will incur a $250.00 including GST fee. Cancellations within 24 hours will incur the full inspection and Report fee.
Limitations on Liability
Any disputes regarding the Report must be raised within 7 days. No alterations should be made to disputed conditions before re-inspection by the Company, except in emergencies. Failure to notify within this timeframe waives claims regarding the condition in question.
The Company, its employees, and officers are not liable for any loss or damage arising from the inspection or Report.
If liability is established, it is limited to the cost of the inspection and Report.
No warranties are provided regarding the Report’s content, and the Company is not liable for third-party information included in the Report.
Intellectual Property and Copyright
The Report is the Company’s intellectual property and is intended exclusively for you. You agree not to share or distribute the Report without the Company’s written permission, except with professional advisors for sale and purchase conditions.
The Company disclaims liability to any third party relying on the Report.
Acceptance
By instructing the Company and receiving confirmation, you accept these terms and conditions as binding.
